Golf Cart Ordinance

ORDINANCE NO. 2009-04

 

AN ORDINANCE AMENDING THE MOTOR VEHICLE AND TRAFFIC CODE OF THE CITY OF TIPTON TO ALLOW THE LIMITED OPERATION OF GOLF CARTS ON CITY STREETS

 

            WHEREAS, the City Common Council of the City of Tipton, Indiana desires to establish an ordinance amending the motor vehicle and traffic code to allow limited use of golf carts within the corporate limits of the City of Tipton, Indiana; and

 

            WHEREAS, the Board of Public Works and Safety for the City of Tipton, Indiana and the Common Council, pursuant to all applicable sections of the Indiana Code and Tipton Municipal Code, may regulate by ordinance the traffic flow of vehicles throughout the City of Tipton; and

           

            WHEREAS, the necessity exists for the implementation of traffic flow regulation with respect to golf carts on and through the intersections within the City of Tipton; and

           

            WHEREAS, the unregulated conduct in the operation of golf carts within the City of Tipton may present a traffic hazard and safety issue.

 

            NOW THEREFORE, BE IT ORDAINED by the Council of the City of Tipton, Indiana, as follows:

 

Section 1.  Only licensed drivers may operate golf carts within the corporate limits of the City of Tipton, Indiana.

 

Section 2.  Golf carts shall obey all the rules of the road and shall display a slow moving vehicle sign or a red or amber flashing lamp attached to the rear of the cart.

 

Section 3.  Golf carts drivers must obtain an annual inspection and must have the inspection sticker/document displayed at all times.

 

Section 4.  The annual cost of the inspection shall be twenty-five dollars ($25.00) per year.           

 

Section 5.  Golf carts must be equipped with the following standard equipment that is required on an automobile: a horn, headlights, taillights, turn signals, and seat belts. No inspection sticker/document will be issued without all the above equipment.

 

Section 6.  Requires proof of financial responsibility for golf carts operated pursuant to this ordinance.

 

Section 7.  Golf carts may be operated on city highways (streets) only.  State roads (SR 19 and SR 28) may not be driven on except to cross at right angles only.  Golf carts are prohibited from being operated or parked on sidewalks.             

 

Section 8.  Occupants of golf carts must be seated at all times.

 

Section 9.  Golf carts may be operated between sunrise and 10:00 p.m.

 

Section 10.  Municipal golf carts are exempt from this ordinance.  Special events personnel may obtain an exemption from this ordinance if approved by a majority City Council and the Mayor.

 

Section 11.  Any person removing a wrecked or damaged golf cart from a highway/street must remove all glass and foreign materials that the golf cart may have dropped upon the highway.

 

Section 12.  Any person found to be in violation of this Ordinance shall be fined as follows:

  1. First offense: $50.00.
  2. Second offense: $100.00.
  3. Third offense: $250.00.
  4. Fourth offense: $250.00 plus additional fines and costs to be determined by the court.

 

Section 13.   This Ordinance shall be in full force and effect from and after its passage and any publication which may be required of the same by law.
